Legal Standards for Impairment
There are approximately 40,000 to 45,000 Floridians arrested every year for DUIs. A DUI is charged if drivers over 21 years of age have a BAC of 0.08 or higher, those under 21 have a BAC of 0.02 or higher, and commercial drivers have a BAC of 0.04 or higher. If the BAC is higher than 0.15 additional punishment is added.
In 2020, one in four Florida traffic fatalities were from alcohol impaired driving. There are statistics showing that March is the deadliest month for DUI crashes and Florida’s alcohol related driving fatality rate is above the national average.
Fortunately, there’s currently a steady decrease for DUI charges in Florida. This is attributed to rideshares, education and awareness, and fewer numbers of young people choosing to drive.
